BMW Financial Services NA, LLC was established in 1993, supporting the sales and marketing of BMW products. Subsequently, we have expanded beyond the leasing, retail and commercial financing of a traditional captive-finance company offering a broad variety of products tailored for the BMW, MINI and Rolls-Royce customer. BMW Group Legal Department Corporate Counsel are primarily responsible for providing expert comprehensive legal advice for the BMW Group and its companies, officers, directors, management, and employees on business critical, strategic, high risk and exposure, regulatory, compliance, public policy, and day-to-day matters. They are expected to perform as much legal work as possible in-house, control legal costs, and manage and direct law firms, experts, legislative counsel, lobbyists, vendors, suppliers, Alternate Dispute Resolution providers, and other third parties in handling BMW Group legal affairs.
The ideal candidate will:
Provide legal advice and support regarding all federal, state, and local laws and regulations related to consumer and commercial motor vehicle financing and leasing applicable to the operations of BMW Financial Services NA, LLC (“BMW FS”), BMW Bank of North America, BMW Mobility Services, LLC, and other BMW Group Companies. Within BMW FS, such legal advice and support will be provided to all business units including Collections, Customer Service, New Business (consumer credit and funding), Compliance, Risk, Lease End, Sales and Marketing, Licensing, and Commercial Finance.
Handle consumer and commercial litigation and prelitigation matters in a cost-effective manner while minimizing legal risks.
Manage legislative affairs by tracking pending legislation and other legal developments impacting consumer finance from a captive finance company perspective and from time to time, work with trade associations and BMW legislative counsel to provide comments consistent with the interests of the BMW Group companies on pending legislation and proposed rules and regulations.
Review, revise, draft, and negotiate vendor agreements and other third-party contracts to ensure that BMW Group company interests are fully protected.
Review marketing materials and assist project teams to efficiently rollout new products and initiatives in compliance with all applicable laws and regulations.
Provide legal support to the Corporate Compliance Department in responses to regulatory examinations and its drafting of company policies and procedures.
Review and provide guidance on responses to escalated customer complaints, including regulatory complaints.
Provide backup for other BMW Group lawyers as required from time to time and supervision, training, and mentoring to other members of the Legal Department.

Bachelor’s degree from an accredited college or university
Juris Doctor degree from an accredited law school
A member of the bar association in at least one jurisdiction in the US
Licensed to practice law in Ohio or obtain corporate counsel status in Ohio (registration permitting a member of the bar of a state outside of Ohio to practice in-house; https://www.supremecourt.ohio.gov/AttySvcs/AttyReg/corporatestatus.asp)
5 years of legal experience
Must be able to use Microsoft Office, Lexis/Nexis, and Westlaw
Must be able to travel overnight as necessary
Litigation, contract, collection, bankruptcy, privacy, licensing, consumer finance (including experience with state-regulated motor vehicle financing and leasing), and commercial finance (including, floorplan and real estate financing and dealer trouble) experience, Knowledge of many of the following laws, rules, regulations: Consumer Financial Protection Act of 2010; Truth in Lending and Regulation Z; Consumer Leasing Act and Regulation M; Equal Credit Opportunity Act and Regulation B; Unfair, Deceptive or Abusive Acts or Practices; Fair Credit Reporting Act and Regulation V; Fair Debt Collection Practices Act; Telephone Consumer Protection Act; Servicemembers Civil Relief Act; US Bankruptcy Code; Right to Financial Privacy Act; Gramm-Leach-Bliley Act Privacy Rule/Safeguards Rule; Electronic Signatures in Global and National Commerce Act; Electronic Funds Transfer Act and Regulation E; Federal Trade Commission Act and Federal Advertising Rules; OFAC Requirements; NACHA Rules; and the state equivalents
Prior legal experience with another motor vehicle finance company is desired, but not required
